What Are the Penalties for Multiple DUI Offenses in Cincinnati, OH?

The penalties for DUI convictions increase with each subsequent conviction within a 10-year period. You face harsher penalties if this is your 6th DUI offense in 20 years. The penalties you face for multiple DUIs in Cincinnati are:

Conviction for a 1st DUI Offense in Ohio

For your first DUI conviction, the judge may sentence you to:

  • A minimum of three consecutive days in jail or a 3-day driver intervention program
  • A fine of between $375 and $1,075
  • Up to five years of DUI probation
  • Court-ordered suspension of your driver’s license for one to three years

The court may also order you to install an ignition interlock device (IID). If your BAC (blood alcohol content) was in a high tier, the court may also add three days to your jail sentence and order you to use a restricted license plate.

Conviction for a 2nd DUI Offense in Ohio Within 10 Years

A second conviction for DUI increases many of the penalties. Your conviction could result in a sentence of:

  • Minimum of 10 days jail, maximum of six months jail
  • A fine of up to $1,625.00
  • Driver’s license suspension for a minimum of one year to a maximum of seven years
  • A possible period of house arrest with electronic and alcohol monitoring
  • Mandatory completion of addiction assessment and treatment program

The judge may also order you to complete a driver intervention program. The minimum jail term doubles for high-tier BAC results.

Conviction for a 3rd DUI Offense in Ohio Within 10 Years

A third DUI conviction within ten years increases the penalties, including many mandatory terms. A judge may order you to:

  • Serve 30 consecutive days in jail, but could increase the term up to one year
  • The fine increases to a minimum of $850 with a maximum of $2,750
  • You must attend an alcohol treatment program that you pay to attend
  • Vehicle forfeiture if it is registered in your name
  • Probation up to five years
  • Court-ordered suspension of your driver’s license for two to ten years with no privileges for the first 180 days and then only after that with an IID installed and restricted license plates

Judges may choose an alternate jail sentence depending on the facts of the case. You could spend 15 days in jail and 55 days to one year on house arrest. However, the minimum jail time doubles for high-tier BAC levels.

Conviction for a 4th or 5th DUI Offense in Ohio Within 10 Years or a 6th DUI Offense in 20 Years

Judges view multiple DUIs severely. If you have four or more DUI offenses within ten years or you are convicted of a sixth DUI in 30 years, you face:

  • A fine of $1,350 to $10,500
  • A minimum of 60 days in jail and up to one year, with the minimum time doubled for a high-tier BAC level
  • Mandatory criminal forfeiture of the vehicle if it is titled in your name
  • You must pay for and attend a mandatory drug/alcohol treatment program
  • Up to 5 years of probation
  • Court-ordered suspension of your driver’s license for a minimum of three years

The judge could order a longer suspension period for your driver’s license, including permanent revocation.

It is important to remember that the above sentences may be enhanced if aggravating factors are present. Also, the driver’s license suspension ordered by the court is in addition to an Administrative License Suspension for refusing a blood alcohol test or for having a prohibited BAC level.
